Trademarks/Service Marks and Trade Dress

Trademarks, service marks, and trade dress all help consumers identify your company as the source of products or services. They are a powerful tool for developing and protecting your company’s brand.

trademark is any word, term, name, symbol or design or combination thereof which identifies a product or a service and distinguishes it from the products or services of others. A service mark is the same as a trademark but relates to a service instead of a product.

Trade dress refers to the total “look and feel” of a product, its packaging, or a place of business. For example, the shape of a product itself, such as the classic Coca Cola bottle design; the color used in packaging, such as the Tiffany Blue Box, or the overall appearance of the interior restaurant all may be protectable trade dress.
